    “Quorum” has been defined in slightly different ways in code sections establishing public councils. This proposal seeks to establish a consistent definition of “quorum” to be used by all public councils established through the code. “Quorum” in the Definitions portion of Section 1-202 Public Meetings would read:

    “Quorum” means the majority of the public council then-appointed and eligible to vote.

    An action of the public council would then be delineated in the Procedures to read:

    Action. Approval of a majority of those voting shall constitute an action of the public council.

    The proposal also includes amendments to the following code sections to replace definitions of “quorum” with a reference to the definition in ACJA § 1-202:
    Section 1-104: Judicial Council
    Section 1-105: Committee on Superior Court
    Section 1-106: Committee on Limited Jurisdiction Courts
    Section 1-107: Commission on Diversity, Equality, and Justice in the Judiciary
    Section 1-108: Committee on Judicial Education and Training
    Section 1-109: Commission on Technology
    Section 1-110: Committee on the Impact of Domestic Violence and the Courts
    Section 1-111: Commission on Victims in the Courts
    Section 1-112: Committee on Family Court
    Section 1-113: Arizona Commission on Access to Justice
    Section 5-104: Alternative Dispute Resolution
    Section 6-114: Committee on Probation
    Section 6-303: Committee On Juvenile Courts

    Note: Section 7-201: General Requirements concerning CLD’s programs will also include a reference to the definition of quorum in 1-202, effective July 1, 2026.

    To Whom It May Concern,

    I applaud this effort to further define Quorum for these groups.

    I write to suggest an additional resulting change in the definition of "Public Council" in ACJA 1-202(B) to make clear that the public meeting provisions also apply to groups established by the Arizona Code of Judicial Administration (as well as administrative order, court rule or statute). The Arizona Commission on Access to Justice is an example of one such group that used to be established by Administrative Orders, but is now established by ACJA 1-113.

    Although there are several ways to accomplish that, let me suggest the following as one alternative (with suggested additions in bracketed language in CAPS):

    “Public council” means any council, commission, board, or committee established by [THIS CODE,] administrative order, [OR COURT RULE] that includes any public members or members who are judges or employees of different courts or established by a statute [] that provides for the supreme court to appoint members and adopt rules.

    Given this suggestion, I would recommend removing the proposed addition of "or court rule" toward the end of the text where the [] are located, given that concept is addressed earlier in the text.
